An Act to Amend the Atlantic Provinces Harness Racing Commission Act

His Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1 The title of the Atlantic Provinces Harness Racing Commission Act, chapter 119 of the Revised Statutes, 2014, is repealed and the following is substituted:

Maritime Provinces Harness Racing Commission Act

2 Section 1 of the Act is amended

(a)  by repealing the definition “Atlantic Provinces”;

(b)  by repealing the definition “Council” and substituting the following:

“Council” means the Council of Maritime Premiers established under the Council of Maritime Premiers Act. (Conseil)

(c)  in the definition “Commission” by striking out “Atlantic Provinces Harness Racing Commission” and substituting “Maritime Provinces Harness Racing Commission”;

(d)  by adding the following definition in alphabetical order:

“Maritime provinces” means the Province of New Brunswick, the Province of Nova Scotia and the Province of Prince Edward Island. (provinces maritimes)

3 Section 2 of the Act is amended by striking out “Atlantic Provinces” and substituting “Maritime provinces”.

4 Section 3 of the Act is amended

(a)  by repealing subsection (1) and substituting the following:

3( 1) The body established as the Maritime Provinces Harness Racing Commission by the Council and continued as the Atlantic Provinces Harness Racing Commission is continued as the Maritime Provinces Harness Racing Commission.

(b)  in subsection (2) by striking out “Atlantic Provinces” and substituting “Maritime provinces”;

(c)  in subsection (3) by striking out “subsection (5)” and substituting “subsection (5.1)”;

(d)  by repealing subsection (5);

(e)  by adding before section 4 the following:

3( 5.1) A member of the Commission who held office immediately before the commencement of this subsection continues in office until the member resigns or is reappointed or replaced.

5 Section 4 of the Act is amended

(a)  in subsection (1) by striking out “eight” and substituting “six”;

(b)  in subsection (3) by striking out “Atlantic Provinces” and substituting “Maritime provinces”.

6 Subsection 5(2) of the Act is amended by striking out “Five members” and “the Atlantic Provinces” and substituting “Four members” and “the Maritime provinces”, respectively.

7 Section 14 of the Act is amended by striking out “Atlantic Provinces” and substituting “Maritime provinces”.

8 Section 15 of the Act is amended

(a)  in paragraph (1)(b) by striking out “Atlantic Provinces” and substituting “Maritime provinces”;

(b)  in subsection (2) by striking out “Atlantic Provinces” and substituting “Maritime provinces”.

TRANSITIONAL PROVISIONS, CONSEQUENTIAL AMENDMENTS AND COMMENCEMENT

Transitional provisions

9( 1) If in an Act, other than this Act, or in a regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Atlantic Provinces Harness Racing Commission Act, it shall be read, unless the context otherwise requires, as a reference to the Maritime Provinces Harness Racing Commission Act.

9( 2) If in an Act, other than this Act, or in a regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Atlantic Provinces Harness Racing Commission, it shall be read, unless the context otherwise requires, as a reference to the Maritime Provinces Harness Racing Commission.

Regulation under the Atlantic Provinces Harness Racing Commission Act

10 New Brunswick Regulation 2003-1 under the Atlantic Provinces Harness Racing Commission Act is amended

(a)  in the enacting clause by striking out “Atlantic” and substituting “Maritime”;

(b)  in section 1 by striking out “Atlantic” and substituting “Maritime”;

(c)  in section 2 in the definition “Act” by striking out “Atlantic” and substituting “Maritime”.

Commencement

11 This Act or any provision of it comes into force on a day or days to be fixed by proclamation.
